Terms of Service

Please read these Terms of Service ("Terms") carefully before using the DeployFly platform. By creating an account or using any part of the service, you agree to be bound by these Terms. If you do not agree, do not use DeployFly.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you (or the entity you represent) and DeployFly. If you are using DeployFly on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

2. Description of Service

DeployFly is a browser-based server management panel that allows users to connect their own Virtual Private Servers (VPS) and manage them through our interface. The service includes features such as stack installation, application hosting, SSL management, database management, monitoring, git deployment, file management, and related tools.

DeployFly provides a management interface only — we do not provide, own, or operate the underlying VPS servers you connect to the platform. You are solely responsible for your servers, their content, and the costs of your VPS hosting providers.

3. Eligibility

You must be at least 18 years of age to create an account and use DeployFly. By using the service, you represent and warrant that you meet this requirement. Users under 18 may only use DeployFly with the documented consent and direct supervision of a parent or legal guardian who agrees to these Terms.

4. Account Registration and Security

You must provide accurate, current, and complete information during registration. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to:

• Create a strong, unique password and not share it with others
• Enable two-factor authentication (2FA) where possible
• Notify us immediately at security@vpspro.io if you suspect unauthorised access to your account
• Not use another user's account without their explicit permission

DeployFly is not liable for any loss or damage arising from your failure to maintain account security.

5. Acceptable Use

You may use DeployFly only for lawful purposes and in accordance with these Terms. You agree to use the service to manage servers and deploy applications in a manner consistent with applicable laws and regulations in your jurisdiction.

6. Prohibited Activities

You must not use DeployFly to:

• Host, distribute, or facilitate illegal content of any kind
• Conduct distributed denial-of-service (DDoS) attacks or any form of cyber attack
• Send unsolicited bulk email (spam) or operate mass-mailing services without proper opt-in consent
• Mine cryptocurrencies on servers without the server owner's consent
• Host content that infringes intellectual property rights, including pirated software or media
• Reverse-engineer, decompile, or attempt to extract the source code of DeployFly
• Resell access to the DeployFly platform to third parties without an Agency plan
• Attempt to gain unauthorised access to our systems or another user's account
• Violate any applicable law, regulation, or third-party terms of service

Violation of these prohibitions may result in immediate account suspension or termination, without refund, at our sole discretion.

7. Your Servers and Content

You retain full ownership of your VPS servers and all content hosted on them. By connecting a server to DeployFly, you grant us limited permission to execute management commands on that server on your behalf.

You are solely responsible for ensuring that the content and services on your servers comply with all applicable laws, and that you have the right to use any software, data, or other content hosted there. DeployFly is not responsible for your server content in any way.

8. Payment and Billing

DeployFly is a subscription-based service billed monthly or annually in advance. By providing a payment method, you authorise us to charge the applicable subscription fee. All fees are in US Dollars (USD) unless otherwise stated, and are exclusive of applicable taxes.

Failed payments may result in a grace period, after which your account may be suspended. You are responsible for keeping your billing information up to date. Refunds are subject to our Refund Policy.

9. Subscription Plans and Changes

DeployFly offers multiple subscription tiers (Starter, Growth, Pro, Agency). The features and limits of each plan are described on our pricing page. We reserve the right to modify plan limits, features, and pricing at any time, with at least 30 days' notice for existing subscribers. Early access pricing is locked for subscribers who join during the launch period, as described at the time of signup, for as long as they maintain an active subscription.

10. Service Availability

We aim to provide a reliable service but do not guarantee 100% uptime. The platform may experience downtime for maintenance, updates, or circumstances beyond our control. We will endeavour to schedule maintenance during off-peak hours and provide advance notice where possible.

DeployFly is not responsible for downtime caused by your VPS provider, your internet connection, or factors outside of our reasonable control. The availability of the management panel does not affect the availability of your servers themselves — your servers continue running independently.

11. Intellectual Property

DeployFly and all related software, designs, logos, trademarks, and content are the intellectual property of DeployFly and its licensors. Nothing in these Terms grants you a right to use our trademarks or branding without our prior written consent.

You retain ownership of any custom configurations, scripts, or code you create using the platform. You grant DeployFly a limited licence to store and execute such content solely for the purpose of providing the service.

12. Confidentiality

Each party agrees to keep confidential any non-public information disclosed by the other party in connection with the service. DeployFly will treat your server credentials and application data as confidential and will not access your servers except as necessary to provide the service or to investigate a reported security incident.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VPSPRO AND ITS DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION — ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO VPSPRO IN THE THREE MONTHS IMMEDIATELY PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless DeployFly and its officers, directors, employees, and agents from and against any claims, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the service in violation of these Terms; (b) your server content; (c) your violation of any third party's rights; or (d) your violation of any applicable law.

16. Termination

You may close your account at any time from the Account Settings page. We may suspend or terminate your account immediately and without notice if you breach these Terms, engage in fraudulent activity, or fail to pay subscription fees after a grace period.

Upon termination, your access to the panel is revoked. Your data is retained for 30 days (see our Privacy Policy) before permanent deletion. Termination does not entitle you to a refund unless stated in our Refund Policy.

17. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any dispute arising under these Terms shall first be subject to good-faith negotiation. If unresolved within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the relevant arbitration authority in the jurisdiction where DeployFly operates.

18. Changes to These Terms

We may revise these Terms at any time. We will notify you of material changes by email and/or by posting a notice in the panel at least 14 days before they take effect. Your continued use of DeployFly after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the new Terms, you must stop using the service before they take effect.
